Right of Withdrawal for Consumers

(A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their self-employed professional activity.)

Right of Withdrawal

You have the right to withdraw from this contract within 14 days without giving any reason.

The withdrawal period is 14 days from the day

• on which you or a third party named by you, who is not the carrier, have or has taken possession of the goods, if you have ordered one or more goods as part of a single order and they are delivered uniformly;
• on which you or a third party named by you, who is not the carrier, have or has taken possession of the last item, if you have ordered multiple goods as part of a single order and they are delivered separately;
• on which you or a third party named by you, who is not the carrier, have or has taken possession of the last partial shipment or the last piece, if you have ordered a product that is delivered in multiple partial shipments or pieces;

To exercise your right of withdrawal, you must inform us (RCS Pro GmbH, Halskestraße 4a, 47877 Willich, Phone: 02154-888630, Email: info@lulibu.de) by means of a clear statement (e.g., a letter sent by post or an email) about your decision to withdraw from this contract. You may use the attached sample withdrawal form, but it is not mandatory.

To meet the withdrawal deadline, it is sufficient for you to send the notification of exercising your right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this contract, we will refund all payments we have received from you, including delivery costs (except for additional costs arising from your choice of a delivery method other than the cheapest standard delivery offered by us), without undue delay and no later than 14 days from the day we receive your notification of withdrawal from this contract.

For this refund, we will use the same payment method you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees for this refund.

We may withhold the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier.

You must return or hand over the goods to us without undue delay and in any case no later than 14 days from the day you inform us of your withdrawal from this contract. The deadline is met if you send the goods before the 14-day period expires.

You bear the direct costs of returning goods that can be sent by parcel as well as the direct costs of returning goods that cannot be sent by parcel. The costs for non-parcelable goods are estimated at a maximum of approximately 90 EUR.

You are only liable for any diminished value of the goods if this loss of value is due to handling that is not necessary for testing the condition, properties, and functionality of the goods.

Exclusions or Expiration of the Right of Withdrawal

The right of withdrawal does not apply to contracts

• for the delivery of goods that are not prefabricated and for whose production an individual selection or specification by the consumer is decisive or that are clearly tailored to the personal needs of the consumer;
• for the delivery of goods that can spoil quickly or whose expiration date would be quickly exceeded;
• for the delivery of alcoholic beverages whose price was agreed upon at the time of contract conclusion, but which can be delivered no earlier than 30 days after contract conclusion and whose current value depends on market fluctuations beyond the entrepreneur’s control;
• for the delivery of newspapers, magazines, or periodicals, except for subscription contracts.

The right of withdrawal expires prematurely for contracts

• for the delivery of sealed goods that are not suitable for return due to health protection or hygiene reasons, if their seal has been removed after delivery;
• for the delivery of goods that, due to their nature, were inseparably mixed with other items after delivery;
• for the delivery of audio or video recordings or computer software in sealed packaging, if the seal has been removed after delivery.
